Summary: Use our app responsibly, pay for subscriptions if you choose them, and we'll provide you with great estimating software. We're not liable for your business decisions.

1. Acceptance of Terms

By downloading, installing, or using Estipro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Estipro is a mobile application designed to help HVAC professionals create estimates, generate invoices, and manage their business. The App provides:

Estimate creation and management
PDF invoice generation
Client information storage
Photo documentation
Digital signature capture
Payment tracking
Cloud backup (optional)

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your password
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier with limited functionality (3 estimates). No payment is required for the free tier.

4.2 Paid Subscriptions

Pro and Business subscriptions are available for monthly or annual billing. Subscriptions are processed through the App Store (iOS) or Google Play (Android) and are subject to the respective platform's terms.

4.3 Billing

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Payment will be charged to your Apple ID (iOS) or Google Play account (Android) at confirmation of purchase
Your account will be charged for renewal within 24 hours prior to the end of the current period
Prices may change with reasonable notice

4.4 Refunds

Refund requests are handled by the App Store (iOS) or Google Play (Android) according to their respective refund policies. We cannot process refunds directly.

4.5 Cancellation

You may cancel your subscription at any time through your App Store account settings (iOS) or Google Play (Android). You will retain access until the end of your current billing period. Deleting the app does not cancel your subscription.

5. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose
Attempt to reverse engineer or hack the App
Share your account with others
Upload malicious content or viruses
Violate any applicable laws or regulations
Infringe on the rights of others
Use the App to harass or harm others

6. Your Data and Content

6.1 Ownership

You retain ownership of all data and content you create in the App, including estimates, client information, photos, and documents.

6.2 License to Us

You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the App's services to you.

6.3 Backup Responsibility

While we offer cloud backup features, you are responsible for maintaining your own backups of critical business data.

7. Intellectual Property

The App, including its design, features, code, and content, is owned by Estipro and protected by copyright and other intellectual property laws. You may not:

Copy or modify the App
Create derivative works
Reverse engineer the App
Remove any proprietary notices

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements. Use of the App is at your own risk.

Specifically, we make no warranties regarding:

Accuracy of calculations or estimates
Suitability for your specific business needs
Continuous availability of the service
Security of data (though we take reasonable precautions)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages exceeding the amount you paid us in the past 12 months

This limitation applies regardless of the legal theory (contract, tort, etc.) and even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Estipro, its officers, directors, and employees from any claims, damages, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you submit through the App

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. Upon termination:

Your right to use the App ceases immediately
We may delete your data after a reasonable period
Provisions that should survive termination will remain in effect

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the App will be resolved through:

Good faith negotiation
Mediation (if negotiation fails)
Binding arbitration (if mediation fails)

Class action lawsuits and class-wide arbitration are not permitted.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Estipro regarding the App.
